TransactionFlow™ (“Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you:

  • Use our products and services (collectively, the “Services”)
  • Opt in to receive SMS or MMS text messages from us (the “Text Messaging Program”)

By using our Site or Services or by opting in to receive text messages, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Site, do not use the Services, and do not opt in to text messages. Geographic Scope: This Privacy Policy applies to users in the United States only.

  • We do not store full credit card numbers on our servers

  • Client contacts and transaction parties (lenders, title companies, attorneys, etc.)

Transaction Data:

  • Property addresses, listing details, purchase prices
  • Transaction dates (contract, inspection, appraisal, closing)
  • Party names and contact information (buyers, sellers, lenders, title companies)
  • Documents, notes, and correspondence related to transactions

Communications:

  • Content of messages you send to us via email, web forms, chat, or SMS

Add-On Service Partners:

  • If you purchase add-on services (such as agent safety tools, floor plans, or virtual staging), we may share limited data with the third-party partner providing that service, and they may share service results back with us
  • Data shared is limited to what is necessary to deliver the add-on service you opted into

Public Records:

  • If you enable integrations, we may access MLS data, property records, public transaction information
  • Used only to populate your account with property information

Your Customers: When your clients interact with branded client portals, we collect:

Analytics Services:

3. SMS/Text Messaging Program

When you opt in to receive SMS/MMS communications from us, the following additional terms apply.

  • Service updates and system status
  • Critical deadline reminders

Service & Support Messages:

3.4 SMS Opt-In and Opt-Out

Opt-In: You may opt in to receive text messages by:

  • Providing your mobile phone number through our Site or during signup
  • Confirming consent via checkbox or reply message
  • We clearly describe what messages you will receive

Opt-Out: You may opt out of marketing text messages at any time by:

  • Replying STOP to any message we send

  • Updating preferences in your account dashboard

After opting out:

  • We send a single confirmation message to verify your opt-out
  • You will not receive further marketing text messages unless you subsequently opt in again

  • Mobile carriers are not liable for delayed or undelivered messages

  • Providing Flow- AI coordination (calls, texts, emails to transaction parties)
  • Sending you marketing and promotional communications (with consent)

Referral Program:

  • Processing and tracking referral credits and commissions
  • Tracking affiliate cookie data to attribute referrals
  • Managing referral program eligibility, payouts, and compliance

Improvement & Analytics:

  • Analyzing usage patterns to improve the Services
  • Training and improving Flow- AI accuracy and capabilities
  • Developing new features based on user needs
  • Conducting research and creating anonymized benchmarking data

Security & Compliance:

  • Protecting the security and integrity of our systems
  • Preventing fraud, abuse, and unauthorized access
  • Enforcing our agreements and policies
  • Complying with applicable federal, state (including Georgia), and local legal obligations

Business Operations:

  • Accounting, auditing, and financial reporting

5. Sharing Your Information

We do not sell your personal information, including your mobile phone number, to third parties. We may share your information with:

Third parties that perform services on our behalf:

  • Payment processing (Stripe) — To process subscription payments
  • Cloud infrastructure (hosting providers) — To host and store data
  • Email and SMS delivery — To send communications on your behalf
  • Analytics services — To understand usage patterns (anonymized where possible)

  • Referral and affiliate tracking — To manage referral program attribution, credits, and payouts

These providers are required to protect your information, may only use it as instructed by us for providing services, and are bound by confidentiality agreements.

5.2 Add-On Service Partners

If you purchase optional add-on services (such as agent safety tools, floor plans, virtual staging, or similar features), we may share limited information with the third-party partner providing that service. Data shared is limited to what is necessary to deliver the specific add-on service you opted into. These partners are bound by data processing agreements and may not use your information for their own independent purposes.

5.3 Business Transfers

In connection with a merger, acquisition, sale of all or a portion of our business, financing, due diligence, or corporate reorganization, your information may be transferred subject to reasonable confidentiality protections. You will be notified via email. The new owner must honor privacy commitments or give you the opportunity to delete your data.

5.4 Legal & Compliance

When required or permitted by law:

  • To comply with legal process (subpoena, court order, government request)
  • To investigate, prevent, or take action regarding illegal activities
  • To protect our rights, property, or safety
  • To protect the rights, property, or safety of users or the public
  • To enforce our Terms of Service

We will notify you of legal requests unless legally prohibited from doing so, notification would compromise an investigation, or emergency circumstances exist.

5.5 With Your Consent

We may share your information with third parties when you explicitly consent or direct us to do so (e.g., integrations you enable, public testimonials you approve).

5.6 Aggregated & Anonymized Data

We may share aggregated, anonymized data that cannot identify you for industry benchmarking, research and analysis, blog content and thought leadership, marketing materials, and similar purposes. This data may include market trends and statistics, platform usage metrics, and performance benchmarks. Vendor Protections: We prohibit our SMS, email, and communication vendors from selling your mobile number or contact information, using your data for their own independent marketing, or sharing your data with other clients.

6. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy.

6.1 Active Accounts

While your account is active, we retain all data indefinitely as you need it for your business. You can delete specific records anytime (contacts, transactions). You control what data exists in your account.

6.2 After Cancellation

60-day retention period:

  • Data preserved in read-only mode
  • You can export all data anytime during this period
  • You may reactivate your account during this period; however, reactivation will be at the then-current standard pricing. Founding Member pricing is not reinstated upon reactivation

After 60 days:

  • Automatic permanent deletion from production systems
  • Backups containing your data overwritten within 30 days
  • Data cannot be recovered
  • We send a final notification at day 55

Immediate Deletion Option:

  • Request immediate deletion by emailing [email protected]
  • Processed within 7 business days
  • Waives reactivation rights
  • Confirmation email sent when complete

6.3 Specific Retention Periods

  • SMS Consent Records: 4 years (FCC compliance requirement)
  • Financial Records: 7 years (tax and accounting compliance)
  • Legal Holds: As required by law (litigation, investigation, regulatory requirement)
  • Backups: Rolling 30-day window (automatically overwritten)
  • Support Communications: 2 years (for quality and training purposes)
  • Referral and Affiliate Records: Duration of active referral program participation plus 2 years

6.4 Deletion Exceptions

We may retain data longer when:

  • Required by law or legal process
  • Necessary to resolve disputes
  • Necessary to enforce our agreements
  • Necessary for fraud prevention or security
  • You have unpaid balances or obligations

7. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information.

7.1 Technical Safeguards

  • Access to customer data limited to authorized team members on a need-to-know basis

7.2 Administrative Safeguards

Employee Training:

  • Confidentiality agreements required

Vendor Management:

  • Security assessments of third-party providers
  • Data processing agreements required
  • Regular vendor security reviews

7.3 Your Responsibilities

You can help protect your data by:

  • Not sharing login credentials with unauthorized persons
  • Logging out on shared or public devices
  • Keeping your contact information current

7.4 Limitations

No Method of Transmission or Storage is 100% Secure: We cannot guarantee absolute security against all possible threats. You use the Services at your own risk. We are not liable for unauthorized access caused by factors outside our reasonable control. Data Breach Notification: If we experience a security breach affecting your personal data, we will notify you within 72 hours as required by law. Notification will include the nature of the breach and data potentially affected, steps we are taking to resolve and prevent recurrence, recommended actions for your protection, and contact information for questions.

8. Your Choices & Rights

Depending on where you live and applicable law, you may have certain rights related to your personal information.

8.1 Access & Export

Right to Access:

  • Request a copy of all personal data we have about you
  • Request details about how we use your data
  • Request a list of third parties with whom we have shared your data

Data Export:

  • Available 24/7 via account dashboard (one-click download)
  • Formats: CSV (contacts, transactions), PDF (documents, reports), JSON (full account data)
  • No fees for data export
  • Export includes all your business data

8.2 Correction & Deletion

Right to Correct:

  • Update inaccurate information in your account settings
  • Request correction of data you cannot directly edit

Right to Delete:

  • Request permanent deletion of your personal data
  • Subject to legal and contractual restrictions (e.g., financial records, active subscriptions)
  • Processed within 30 days

8.3 Marketing Opt-Out

Email Marketing:

  • Click the “unsubscribe” link in any marketing email
  • Update preferences in account settings
  • Email [email protected] to opt out

SMS Marketing:

  • Reply STOP to any marketing text message
  • Will not affect transactional messages (account alerts, security notifications)

Note: You cannot opt out of transactional emails/SMS required for service delivery and account security.

Our Services are operated from the United States and intended for users in the United States only.

11.1 Data Storage Location

All data is stored on servers located in the United States. Backups may be stored in other US regions. All storage and transfers comply with applicable federal and state laws.

11.2 Users Outside the United States

Our Services are not designed for or directed to users outside the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. We make no representations that the Services are appropriate or available for use in other jurisdictions.

12. Third-Party Websites & Services

Our Site and Services may contain links to third-party websites or integrate with third-party services that are not operated by us. Examples include MLS systems, document signing services, file storage providers, and social media platforms.

12.1 We Are Not Responsible For:

  • Content, accuracy, or availability of third-party services
  • Privacy practices or data collection by third parties
  • Terms of service or policies of third-party services
  • Any damages or losses from using third-party services

12.2 Your Responsibility

When using third-party services, review their privacy policies and terms before use, understand what data they collect and how they use it, be cautious when providing personal information, and contact them directly with privacy questions. We recommend reading privacy policies of any third-party service before connecting and regularly reviewing connected third-party services in your account.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or services, changes in applicable laws, new features or technologies, or customer feedback.

When we make changes, we update the “Last Updated” date at the top of this page and provide notice via email to your account email address, prominent in-app notification when you log in, or notice on our website homepage.
